12b6:what a time to be aliveFor those of you who didn’t bother read the actual article and are butthurt at me for posting it (????), and for those of you not familiar with how the First Amendment actually works***:The idea is that this is unconstitutional because he’s the president USA, aka the government. The First Amendment applies to the government restricting people talking about/at the government in a public forum, put most simply. The judge ruled that twitterverse is a public forum, and by not letting people see and talk to him, Trump has violated the First Amendment. The First Amendment isn’t about “you can say whatever you want.” It’s a lot more nuanced than that. Mostly it’s there to make sure that people aren’t afraid to criticize the government. As the people Trump’s been blocking likely were criticizing him/the government, the argument is that their First Amendment rights have been violated. They are no longer allowed to see his posts/talk to him. Disclaimer - I don’t currently practice in this area, this is based on the basics I learned in law school. ***I don’t know if this ruling will stand, or if I even agree with it. It’s a creative argument that has worked in this instance, at the very least, and also PRETTY FUCKING HILARIOUS AMIRITE -- source link
