There’s an interesting story behind this residential building in TriBeCa (Greenwich str & Canal str), which I pass by every time I go to Trader Joe’s. In 2013 Tribeca artist, Arne Svenson, who lived across the building, secretly snapped the residents of this building with ceiling-to-floor windows, and these photographs then became part of the controversial exhibit “The Neighbors” and were showcased at a Chelsea gallery. The problem was that he took pictures without the consent of the residents. So, when they found out about these photos going public, it outraged them and they took him to court, because some of them featured intimate moments and most importantly - children! However, a Manhattan judge dismissed a legal complaint filed by the parents of two of his underage subjects, citing the reason that “art photographers do not need the consent of the subjects they use in artistic photographs” and called Svenson’s work a form of art, through which he communicates his “thoughts and ideas to the public. The couple argued that Svenson’s commercial use of the photos violated their civil rights. While Svenson was careful to obscure the faces in the photographs, many neighbors still felt the photographer had violated their privacy. Even though the artist later removed the photos from his social media, they are still available all over the internet. Many world wide photographers make their careers out of secretly snapping photos of the residential building. There are a lot of them in Paris, for example. But how far one can go? I’m personally fascinated with these kind of photos, however, when it comes to children - I oppose it. Which side would you agree with?
