thefinalmanifesto: poniatowskaja: thefinalmanifesto: poniatowskaja: thefinalmanifesto: thefinalmanifesto: I decided the old map wasn’t good enough, so I’ve started making my own (日本語での新しい地図). The white spots are ones where there isn’t enough information, either because I haven’t gotten around to it, or because I couldn’t find any information. Even so, the areas that are colored aren’t necessarily complete. Finding criminal laws is much easier than finding marriage prohibitions. For example, I would expect all former Soviet republics to have similar laws to Russia, but I don’t know where such marriage restrictions would be written, so I can’t definitively say if they allow avunculate marriage. If anyone has some extra info, or wants to correct something I’ve put on the map, feel free to send me a message. I’d appreciate it. Almost done! Unfortunately, many African countries don’t have digitally accessible penal codes, so I don’t know how many of the white spots I can fill in. However, I think I can find marriage codes for the rest of the countries. I wonder if any country forgot to explicitly ban consanguineous marriage. A lot of these countries and territories also forget to phrase their laws in a way which would apply to homosexual relationships, so I’m planning on making a map at some point explicitly just to show which countries don’t criminalize same-sex consanguinamory - it’s actually a lot of them, which makes it one of the few situations where straight people have it worse. I also want to do a map for step- and adopted family, because they’re frequently targeted explicitly by “incest” laws. By the way: What the hell, America?! Talk about beating everyone by a large margin. The only Anglo-Saxon country to have any territory with legal consanguinamory, is also the one with by far the most brutal legal regimes. Nevada, Texas, Mississippi, and Tennessee will send you to jail for up to 25 years for having sex with your cousin. What kind of barbarism is that? The only place I’ve found which beats that is Zambia, where though you can marry your cousin, sleeping with your brother will get you both thrown in jail for a minimum of 20 years and a maximum of life. Even just attempting to sleep with your brother would get you thrown in jail for 10-25 years. The map codes the law in Poland as only penalising ancestor/descendant sex, but it applies to siblings as well. Article 201 of the criminal code of 1997 sets out a punishment of imprisonment between 3 months and 5 years for sexual intercourse between descendents, ancestors, siblings, as well as with and adopted parent or adopted sibling. Article 14 of the family law code states that courts may authorise, but otherwise marriages between siblings, those within a straight line of descent, or in-laws are not valid. Moreover, anyone with a legal interest may request a cancellation of the marriage because of the familial relationship between the partners, but it seems that only one of the partners may request one based on affinity (the in-law reason). Though as you can be married legally to only one person, it’s strange that people apparently maintain the in-law status following divorce. But marriage is less important than lack of prosecution. Given that it’s effectively an “if the judge is really liberal and nice” requirement for consanguineous marriage, I don’t think I’ll change Poland’s marriage laws here. Also, look at Poland’s color: it’s dark purple, not dark blue, which means it excludes 2nd degree relatives. I know what you’re talking about, because I checked Poland’s criminal code. The only country in Europe I’ve found which falls into the category of only banning ancestor/descendant sex is Estonia. Thanks for the information on Poland’s marriage laws though. (I know it may be somewhat difficult to tell apart the dark blue and dark purple on my map.) It was indeed, I did write that having mistaken it for the dark blue. Sorry! Don’t worry. It motivated me to go back and change the colors so they’re more distinct. Unfortunately I don’t have a lot of wiggle room, because I’ve tried to keep the map as friendly as possible for people who are red/green colorblind. That means most of my colors have to use only red and blue. -- source link
